✦The Daughter of the Earth, born from a seedling:

TOFIE has nurtured the art form of immersive storytelling through sound, building audio realms from the ground up with a passion that stems from a deep reverence for our natural world - all the way down to the tiniest whispers of the forest.

The origin story: TOFIE first broke out onto the scene in 2016 with her debut single, “Sunrise Cutie.” In 2017, her future bass-styled single “2D Dreaming” went on to go viral on the social media app TikTok. In 2020, she produced an official remix for the psychological horror role-playing game OMORI, developed by OMOCAT. Beyond composing, TOFIE has also become known for her signature vocal style in features with many globally recognized producers. In 2019, she did vocal work on “KINGDOM HEARTBEATS,” an officially licensed Kingdom Hearts remix LP by RoboRob, which went on to chart at #14 on Billboard’s Dance/Electronic album sales.Having gone through a metamorphosis of personal discovery over the years, in 2021 she released “Daughter of the Earth,” her gapless playback debut EP that set the stage for her new era and sound. In 2022 she released "Celestials," a full-length original stream soundtrack for Vienna, the beloved cosmic dragon VTuber formerly with Cloud9. In 2023 she produced "LUNAM," an original song for NIJISANJI EN's Uki Violeta. After years of composing, songwriting, vocal arranging, & more for VTubers, she is currently working on her first studio album.

General

【01.】 I reserve the right to refuse a project that I feel I cannot complete sufficiently, due to the nature of the work requested, or for any other reason(s) unspecified. I will be completely honest with you if I feel I cannot create what you’re looking for.【02.】 I retain full rights to the composition, commissioned work, and any rejected demos - including the right to upload them to my own sites/portfolio (Twitter, SoundCloud, etc.), commercially or non-commercially for the purpose of showcasing my work. If you're looking to purchase full rights to the composition and recording, please contact me and we can discuss options.【03.】 I require full payment upfront (USD) via PayPal, Venmo Business, or Stripe before beginning work on the project.
Payment plans are also available on a case-by-case basis for projects of a larger scale.【04.】 All payment is final and non-refundable. If you are in a waitlist or queue and payment has not been exchanged, you are free to forfeit your slot at any point before work begins.【05.】 I work on each project individually. Once it is your turn in the queue and work has begun, my average turnaround is anywhere between one week - three months depending on the scale of the requested deliverables.
Please note that I am less likely to accept your project if you have a deadline. Unfortunately, I deal with chronic health conditions that at times can limit my physical capacity. I take great time and care with my work and always make sure to deliver reasonable updates, so patience from the client is greatly appreciated.【06.】 When using the work in any content, you must provide credit back to either my Twitter or website somewhere reasonably visible. (example: BGM by TOFIE)【07.】 My office hours are Monday - Friday 10:00 AM - 10:00 PM PST, and to preserve work-life balance, I cannot guarantee an immediate response outside of those hours. Promptness of communication within reason between both parties is both expected and appreciated as a sign of mutual respect, so please keep me informed if any emergencies or delays pop up.
Delayed responses on important communications such as project information and WIP feedback may result in the commission being delayed.【08.】 I reserve the right to share (non-NDA) WIPs + completed commissions on social media sites and/or my portfolio.【09.】 Commissions are digital files only, no physical goods will be received. The files will be provided to you via email, Discord, or Twitter, depending on previous methods of communication. Please note that the download link for files will expire 7 days after final delivery.【10.】 For any work involving the creation of derivative content (such as covers, re-arranges, remixes, etc.) I am not responsible for any copyright infringement that may occur. Please ensure that you have secured all licensing rights to create and distribute such content.

During the Process

(For reference, there are three general stages: Composing, Producing, and Mixing + Mastering)

【11.】 Before I begin work, please provide me with 1-3 references that capture the sound that you'd like to achieve. Additionally, it's very helpful to know what you like about them - even if you don't know the exact instruments used or musical terms!
(Example: "I like the flute in this song, and how it has an overall slow and gentle feeling.")【12.】 Revisions Policy:✦ BGM, Character Themes, Original Songs:
One (1) major revision + two (2) minor revisions are included.
Any further desired revisions will be at a rate of $30.00 USD each, and may or may not be possible depending on the ask.✦ Alerts, Jingles, SFX:
One (1) minor revision is included.
Any further desired revisions will be at a rate of $15.00 USD each.For reference:
- Examples of minor revisions: requesting a small melody, instrument, and volume/effects adjustments.
- Examples of major revisions: requesting entirely new melodies, chord progressions, and the removal/addition of entire sections.【13.】 I cannot do any major revisions after the Composing stage is approved, as it can be very difficult to change the structure and foundation of a song - please make sure that you're happy with the general direction during this first stage.
Minor revisions are acceptable during the Producing stage as sound designing begins.
After the final work is approved and files are delivered, no further revisions will be possible.【14.】 You may not download or use any work-in-progress or previews in any content before your work is finished. These are very raw in nature and will be noticeably different from the finished master.
If you want to share WIPs with your community, for example, please be sure to ask me for permission first.

Allowed Usage/Copyright Information:

【15a.】 By paying for the commission, you are granted an exclusive sync license for the completed work which allows for limited commercial use. If you're ever unsure about allowed usage, please freely ask me at any time!With this license, you may:✓ Use the work in your monetized streams
✓ Use the work in monetized videos for sites such as YouTube and Twitter, as long as it is paired alongside original visual content and the audio is not the main focus (stream VODs, tutorials, debut trailers, videos showcasing your Live2D model, etc.)【15b.】 If you'd like to distribute the work to music services (Spotify, Apple Music, etc.), use it in media (games/film), etc: an additional full commercial use fee and/or royalty split agreement will apply depending on the desired usage.
Full commercial use fees start at 2x the price of the commission.

Non-Allowed Usage:

【16.】 Uploading the work for the sole purpose of commercial monetization is not allowed, it must be used alongside your own visual content if monetized.Without a full commercial use license, you may not:✕ Distribute the work to music stores (Spotify, Apple Music, etc.)
✕ Upload a monetized video where showcasing the audio work is the main focus (example: song showcase)【17.】 No one else has permission to use your commissioned work, commercially or non-commercially, unless it is in content pertaining to/involving you and they have your direct permission (OK example: interviews).
However, even with your permission, monetized use by a third-party is prohibited before contacting me first. The only exception to this rule is stream clip channel uploads where the work is heard in the background of the stream clip(s).【18.】 You may not use the work without visible credit to me and/or claim the work as your own or someone else's.【19.】 You may not re-distribute or re-sell the work in any way, including in any blockchain/cryptocurrency-related technology such as NFTs. Please note that the exclusive holder of the license is the person/entity that it was commissioned for, and anyone else who uses it may be subject to copyright infringement and DMCA.【20.】 If a fraudulent chargeback is filed, your license to use the commissioned work will be revoked and it will be re-sold/re-purposed. You will be forbidden from commissioning me again, and your name/handles will be shared publicly to protect others.
